Real Estate / Landlord-Tenant Matters

Real Estate transactions involve the purchase and the sale of properties. Once a contract is entered, the parties have a three (3) day attorney review period in which the attorneys for the buyer and seller review the contract and make the appropriate changes to protect their respective clients. After the property is out of attorney review and under contract, the buyer performs inspections, and makes reasonable requests for the seller to repair any items. A buyer in most purchases will apply for a mortgage for purchase of the property (unless the buyer is a cash buyer). The attorney will also hire a title company to perform a title search in order to make sure there are no judgments, liens, or other property issues with neighbors or prior owners.

Any landlord should have an attorney represent them in landlord/tenant court since there are many procedural requirements that have to be followed for evicting a tenant. If these procedural requirements are not followed, even if there is a good reason to evict the tenant, the court will dismiss the case, and require the tenant to re-file the eviction. These procedural requirements are very technical and need the skill of an attorney to handle. Most leases permit the landlord to collect attorney fees as additional rent. Therefore, a landlord who retains an attorney for court will be permitted to have attorney fees reimbursed by the tenant through the lease.
